The Declaration of Terms and Conditions of Service establishes a legal agreement between the User and the Newtontrips.com website. By using the services of the specified website, the User agrees with the terms and conditions present in this document.

It is mandatory for the User to carefully read these general terms and conditions prior to using the reservation services through Newtontrips.com, as well as to read and understand the particular conditions present in each service, since they may complement and / or alter the present in these general terms and conditions.

By using the Newtontrips.com website, the User declares to be of legal age and full legal capacity to contract services through Newtontrips.com, which will have the role of intermediary between the service provider and the User.

With an enunciative but not limiting character, it is not allowed to:

In particular, the following conditions will apply in general:

1. Liability of the intermediary Newtontrips.com:

Unless otherwise indicated, any service offered by Newtontrips.com through the Website is carried out as an intermediary in the sale. That is, Newtontrips.com only establishes the contact between the Service Provider with potential customers. Therefore, Newtontrips.com is a mediator that is limited to concluding contracts in the name and on behalf of the User on the one hand and the Service Provider or organizer on the other, without promising benefits and without providing them, not binding the result, therefore Newtontrips.com is not responsible for the breach or exact and diligent fulfillment of the services that are part of said contract between the Service Provider or organizer and the User.

Because the User is the one who contracts with the Service Provider, any claim or query related to the service must be directed against the Service Provider. Notwithstanding the foregoing, Newtontrips.com makes its customer service channels available to the User to assist them in relation to any questions or suggestions they may have.

Additionally, Newtontrips.com accepts each and every one of the obligations or prohibitions imposed at any time by the legislation in force in relation to the exclusion or limitation of the professional's responsibility in the fulfillment of the brokerage contract.

In order for the User to have access to the comparison of requested services, the User expressly accepts that Newtontrips.com may carry out on his behalf mere procedures with the Service Provider in order to enable said comparison between services.


2. Cancellations and / or modifications:

You can cancel or modify your reservation free of charge within the cancellation period stated in your reservation voucher / service voucher.

If you want to cancel or modify your reservation, you can send your request to hola@newtontrips.com.

Cancellation of your reservation made within the stipulated period in advance of the service start date will not incur in any charges. The amount paid will always be refunded using the same means of payment and currency chosen by the User in their original payment.

In the event that the financial entity that was used to originally pay the reservation (understand the issuing bank of the buyer's credit or debit card) applies some type of commission for the refund of money or uses an exchange rate different from that applied during the reservation, Newtontrips.com will not be responsible for the application of these charges that are exclusive to the bank that issued the card or fluctuations in the currency exchange market.

In the case of cancellation or partial modification of a reservation, the same deadlines and terms will be taken into account.

Modification of the reservation with the corresponding notice to the start of the service will be subject to the availability offered by the Service Provider and the contracted service will only be modified with the express authorization of the Service Provider.

In the case of canceling or modifying without the corresponding notice specified in the reservation voucher / service voucher, there will be no refund of the amount paid at the time of booking, without prejudice to the events that may have led to the cancellation. It is understood that force majeure events described in this contract are included in this contract in point 10.

In the case of no-show at the start of the service, expenses of 100% of the reservation will be applied, not having any right to claim, even in the event of force majeure.

The Service Provider may modify the start time of the excursion without the consent of the User up to 12 hours before its starting time, this does not imply the alteration of the service itself contracted, nor the right to claim by the User for the modification of the schedule.

In the specific case of the Minitrekking excursion in the Perito Moreno, the standard starting time may be rescheduled for an alternative one, always between 07:00 and 13:00. This rescheduling will also modify the return time of the excursion by the same number of hours, without affecting the services stipulated in the original itinerary.


3. Claims and special requests:

The User may contact in writing to hola@newtontrips.com to make special requests or claims. Newtontrips.com will be in charge of transferring the communication to the Service Providers, and of operating as a mediator between the User and the Provider to seek an agreement between the parties.


4. About the reservation and confirmation process:

To carry out the purchase, the User will be asked for their personal data and the form of payment for the reservation. Notwithstanding the provisions of these General Conditions, and especially regarding the lack of payment, the parties do not commit until the User successfully completes the payment, receives the validation of the purchase by mail and the subsequent confirmation of reservation by our staff.

Once the purchase is completed, the Newtontrips.com reservation staff may contact the user to request more information related to the other participating passengers. The act of providing the information of the requested data is mandatory and will condition the confirmation of the reservation of the services purchased from the User upon sending.

Until before the purchase and during the purchase process, the Newtontrips.com system may warn you of possible errors or omissions in the introduction of mandatory data, the User being able to correct them. Once the purchase is made, Newtontrips.com is not responsible for the errors that the User has made in the introduction of data, without prejudice to being able to exercise their rights in accordance with the regulations on the protection of personal data.

A validation email will be sent to you with the purchase information, which will also be archived by Newtontrips.com. The user has the obligation to review said purchase validation email, and if it contains an error, they should contact Newtontrips.com immediately to be able to correct it, if possible.

Likewise, Newtontrips.com has a maximum period of 48 hours after sending the purchase validation to request the personal data of the remaining participants of the reservation, to send the reservation confirmation to the User, to modify or cancel any reservation in the event that for reasons of market demand or for reasons of fluctuations in last minute availability. In these cases, the User will be informed within a maximum period of 24 hours that the reserved places are not available for the selected day or time and will be offered to reschedule the reservation or cancel it free of charge.


5. About payment of reservations:

There are different rates for Argentines and foreigners. The prices for Argentines with a local ID are those published in pesos on the website and the prices published in dollars on the website are valid for foreigners. You can see the rate according to your nationality by changing the currency on the website or if you make a reservation and the system identifies that you are not Argentine and you are viewing the rates in pesos, it will modify the currency to dollars as appropriate.

The purchase price of the services provided by Newtontrips.com is subject to continuous market fluctuations. In this sense, and unless an imperative norm or Newtontrips.com expressly establishes otherwise, the User may terminate the contract with Newtontrips.com or the Service Provider at any time, taking into account the deadlines of cancellation or modification and their respective charges set forth in point 2 (Cancellations and Modifications) of this contract.

The User will respond to Newtontrips.com that the credit or debit cards they use are their property, with sufficient funds in them to cover the cost of the contracted service. The purchase of any service will only be effective when Newtontrips.com validly charges the credit or debit card provided or the amount of said purchase is received by transfer. Newtontrips.com reserves the right to cancel the reservations made by the User in case of non-payment, refund of the charge, card declined or false information, or in case Newtontrips.com cannot verify the information of your card. Newtontrips.com reserves the right to request additional information from the User in order to verify their purchase.

Requesting a reservation implies the commitment by the User to authorize the charge on the credit or debit card provided. In the event that it is not possible to charge the credit or debit card (rejected transaction), the User understands that, by not having made the payment, the reservation may be canceled by Newtontrips.com.

The prices indicated on Newtontrips.com are inclusive of local taxes and are final prices. They do not include entrance fees to the National Park or lunches (if needed for each particular service), or drinks in those services that require it, except for those cases that are expressly mentioned on the Website.

Newtontrips.com is not responsible for the means of payment accepted by the authorities of National Parks, Service Providers or any other organization that could intervene in the complete provision of the service. Newtontrips.com will inform the User of the auxiliary, complementary and in some cases mandatory services that they make to the main service offered on the Newtontrips.com website and in the voucher. Said rates may undergo modifications between the time of contracting the service and its provision, Newtontrips.com not being responsible for these fluctuations. Variations in the applicable rate due to late payment of the reservation will be passed on to the User.


6. About the required personal data:

The User agrees and is responsible for their data and those that he reports from third parties, are provided through Newtontrips.com, or through communication with our Customer Service staff, who have the authorization of third parties to facilitate them, have read and accepted these General Conditions and, where appropriate, the particular conditions, that they are true, precise, complete and correct, that the names of the passengers exactly match those that appear on their passport or ID, not being Newtontrips.com responsible for such breaches by the User.

If there is any variation in the data provided or any error in the data that Newtontrips.com has, it is the User's responsibility to report the correct ones.

All travelers, including minors, must carry the documentation required by law or authorities, such as passport, ID, travel permits, etc. It is the sole obligation of the traveler to be informed about the documentation required for the international border crossing.

In the case of excursions that involve the international border crossing and travel with minors, the documentation required by Migrations must be carried as documentation that shows that you are traveling with both biological parents or authorization issued by a notary public to leave the country in the presence of only one parent.

The User is responsible for the economic consequences derived from the misuse of their data that the User or an unauthorized third party may carry out, preventing unauthorized third parties from accessing data that only the User should know, such as access to email. with the confirmation of the reservation, access to the voucher or access to your credit or debit card details.


7. About restrictions for excursions:

By reserving a service, the User understands and accepts its specific requirements for its correct performance. By way of example, but not limiting, this point includes age limits, physical conditions (heart problems, knee, hip, back, among others), motor, mental, disability, eating disorders, recent operations, overweight, etc. that may prevent the performance of the activity. If the User has any inconvenience that prevents the performance of the activity and this impediment has been expressly indicated in the details of the service before booking through the Website, there will be no possibility of subsequent claim or refund of the amount paid. Any incident, of any kind, that arises from the User's breach of its management, processing and documentation obligation will not be assumed by Newtontrips.com


8. About the authorized accommodation:

Newtontrips.com will only be able to manage the transfers that the User requires from the Provider when the starting or ending point is in an accommodation duly registered and authorized by the corresponding Municipal entity. Passengers cannot be picked up from private homes or unregistered accommodations. If you are staying in any unregistered accommodation, a meeting point will be indicated to start the excursion.


9. About browsing the Website:

Newtontrips.com makes every effort to avoid any error in the content that may appear on the Website. However, Newtontrips.com is not responsible for the information that the User may obtain through links to external systems that are not dependent on Newtontrips.com. Additionally, Newtontrips.com makes reasonable efforts to keep the Website updated and in good working order. However, Newtontrips.com is not responsible or guarantees that access to the Website is infallible, continuous or free of deficiencies. Nor can it guarantee that the content or software that the User can access through the Website is free of harmful elements, viruses, interferences, breakdowns, omissions, disconnections or other elements that may cause damages to the User or alterations in the computer software or hardware systems of the User or in their electronic documents and files.

10. Definition of Force Majeure:

11. On partial nullity:

Due to the decentralization of the legislative function and control of the legal framework that affects the activity carried out by travel agencies, it is possible that the General Conditions are subject to different jurisdictions or regulations. Therefore, in the event that any condition of the General Conditions is null or void, the validity of the same as a whole will not be affected by said circumstance.

The legally ineffective condition will be replaced by a new one, or interpreted in a legally acceptable way, which is as close as possible to the condition that would have been formalized had they had knowledge of the ineffectiveness of the condition in question.


12. On enforceability:

The fact that Newtontrips.com does not demand, on one occasion, the fulfillment by the User of any condition of the General Conditions, will not affect in any way their right to demand their fulfillment on a later occasion or the right of any other party to demand its fulfillment.

Any waiver by the User of any of the rights or powers derived from the General Conditions must be made in writing. The omission by Newtontrips.com to demand strict compliance with any conditions may not be considered in any case as a waiver, nor will it deprive Newtontrips.com of the right to subsequently demand strict compliance with them.
